End User Licence Agreement

This End User Licence Agreement (“EULA”) is a legal agreement between you and Creature Creative LTD, trading as Creature Audio (“we”, “us”), for the Monster Switch and Monster Switch CONNECT software, including plug-ins, the standalone application, and any updates and documentation (the “Software”). By installing, activating, or using the Software you agree to this EULA. If you do not agree, do not install or use the Software.
During the pre-release period, use of the Software is also subject to the Beta Testing Agreement, which takes precedence where it conflicts with this EULA.
1. Licence grant
Subject to this EULA and your payment of any applicable fees, we grant you a non-exclusive, non-transferable licence to install and use the Software for your own music-production purposes, whether personal or commercial.
2. Activations
Each licence key permits activation on up to two (2) computers that you own or control, subject to any activation limits shown at purchase. You may deactivate a machine from within the Software or your account to free an activation for another computer. Activation requires periodic online validation; reasonable offline use is supported.
3. Restrictions
You must not:
- copy (except one backup), rent, lease, lend, sell, sublicense, or distribute the Software or your licence key;
- reverse-engineer, decompile, or disassemble the Software, except to the extent this restriction is prohibited by law;
- circumvent, disable, or tamper with licensing, activation, or copy-protection;
- share your licence key publicly or use it to exceed your permitted activations.
4. Subscriptions
Monster Switch CONNECT and any other subscription features require an active, paid subscription. If your subscription lapses or is cancelled, those features will stop working, though your core licensed Software will continue to function according to its licence.
5. Ownership
The Software is licensed, not sold. We and our licensors retain all intellectual property rights in the Software. You own the audio and projects you create with it.
6. Updates
We may provide updates, which are covered by this EULA unless they come with separate terms. We are not obliged to provide updates or support indefinitely.
7. Warranty and liability
To the fullest extent permitted by law, the Software is provided “as is” without warranties of any kind. We do not warrant that it will be uninterrupted or error-free. Nothing in this EULA excludes liability that cannot be excluded by law (including for death or personal injury caused by negligence, or for fraud) or affects your statutory rights as a consumer. Subject to that, we are not liable for indirect or consequential loss, loss of data, profits, or business, and our total liability is limited to the amount you paid for the Software.
8. Termination
This licence ends automatically if you breach it. On termination you must stop using and remove all copies of the Software. Sections that by their nature should survive (ownership, warranty disclaimers, liability) survive termination.
9. Governing law
This EULA is governed by the laws of England and Wales, subject to any mandatory consumer protections available to you where you live.
